Blender Open Data

The Blender Open Data initiative (or ‘the Service’) is an open and public platform that offers registered members to share computer system performance data. By registering as a member or by using the service in any way, you accept these Terms of Service ("Agreement"), which forms a binding agreement between you and the Blender Foundation (‘we’ or ‘us’). If you do not wish to be bound by this Agreement, do not use the Blender Open Data Service.

Blender Open Data is an activity conducted by the Stichting Blender Foundation - Buikslotermeerplein 161 - 1025 ET Amsterdam - the Netherlands, founded in the Netherlands under registry Nr. 34176425 contact: foundation@blender.org.

Registration

By registration at the Blender Open Data website, your email address will become the identification ("Blender ID") for services on blender.org in general. Registration is free, and only requires a confirmation of the owner of the email address - by responding to an authentication email.

You may delete your account at any time via your personal account page, or by contacting us at cloudsupport@blender.org.

In case of suspected fraud or abuse of the service after registration, the account owner will be contacted and asked for clarification. Failure to alleviate charges of fraud may result in the termination of the member’s account.

Upon termination, all licenses granted by Blender Open Data will terminate. In the event of account deletion for any reason, content that you submitted may no longer be available. The Blender Foundation shall not be responsible for the loss of such content.

Blender Benchmark

Only applications offered by blender.org and by Blender Foundation have access to provide data to the Blender Open Data website. The only application we offer under this agreement is the “Blender Benchmark” which is a stripped down binary version of the open source software “Blender” as managed and offered on www.blender.org. The sources of the Blender Benchmark are being published as GNU GPL on git.blender.org.

Upon completing the Blender Benchmark, it offers you a choice to submit the benchmark data to Blender Open Data website on blender.org.

Only anonymised performance data is being sent - such as timing and performance numbers, information provided by installed hardware (type strings and version numbers), driver versions and operating system versions. In no way the data can be used to trace back to your system or to you as a person.
By logging in to your account on mydata.blender.org, the Blender website will always offer you to remove provided testing data.

Blender Open Data licences

By using the service, you agree on providing Blender Benchmark results to the Blender Open Data website without any restrictions or limitations. The results will be available for everyone in the Public Domain.

Unless notified otherwise, all digital content of the website itself (webpages, video, artwork, 3D data) is available under the Creative Commons Attribution 4.0.

All software provided on Blender Open Data website will be under a free and open license as recognised as such by the Free Software Foundation.

Trademarks and logos - including the Blender logo - are copyrighted properties, with all rights reserved by its owners.

Indemnification

You will indemnify, defend, and hold harmless the Blender Foundation and its affiliates, directors, officers, employees, and agents, from and against all third party actions that: arise from your activities on the Blender Open Data service; assert a violation by you of any term of this Agreement; or assert that any content you submitted to the Blender Open Data website violates any law or infringes any third party right, including any intellectual property or privacy right.

Availability of the service

The Blender Foundation is not responsible for any damages resulting from the unavailability of the Service.

Modification

This Agreement may not be modified except by a revised Terms of Service posted by the Blender Foundation on the Blender Open Data Site or a written amendment signed by an authorized representative of the Blender Foundation. A revised Terms of Service will be effective as of the date it is posted on the Blender Open Data Site.

THE BLENDER FOUNDATION WILL NOT BE LIABLE FOR ANY LOSS OF INCOME, LOSS OF PROFITS, LOSS OF CONTRACTS, LOSS OF DATA OR FOR ANY INDIRECT, INCIDENTAL, EXEMPLARY, SPECIAL, PUNITIVE OR CONSEQUENTIAL LOSS OR DAMAGE OF ANY KIND HOWSOEVER ARISING AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, WARRANTY OR OTHERWISE. OUR MAXIMUM AGGREGATE LIABILITY UNDER THESE TERMS AND CONDITIONS WHETHER IN TORT (INCLUDING NEGLIGENCE) OR OTHERWISE SHALL IN NO CIRCUMSTANCES EXCEED YOUR ANNUAL MEMBERSHIP FEE.

Disputes

These Terms and any Additional Terms are governed by and construed by the laws of the Netherlands exclusively. The parties agree that any disputes or proceedings between us and you concerning these Terms, any Additional Terms, and/or any of the Websites or Services shall be brought in a court of competent jurisdiction sitting in the Netherlands, and hereby consent to the personal jurisdiction and venue of such court.
